本利用規約は、Appleの標準エンドユーザー使用許諾契約（標準EULA）を補足し、Daynaryの利用およびPremiumサブスクリプションに適用されます。Daynaryを利用することで、本利用規約と適用される標準EULAに同意したものとみなされます。
1. サービスの内容
Daynaryは、日々実際に行ったことを記録、閲覧、検索、分析および書き出しするためのツールです。医療行為、診断、治療または専門的助言を提供するものではありません。FreeとPremiumの機能範囲はアプリ内のPremium詳細に表示します。
2. ユーザーデータと保存
ユーザーが入力または取り込んだ記録の内容はユーザーに帰属します。記録は端末上へ永続保存され、iCloud利用時はプライベートCloudKitを通じて端末間同期されます。「iCloud利用可能」は同期完了または完全なバックアップを保証しません。重要な記録については、アプリ内の書き出し機能等を用いて必要な控えを管理してください。
3. Premiumサブスクリプション
Premiumは月額または年額の自動更新サブスクリプションです。各プランの期間と購入時点の実価格は購入画面に表示され、購入確認時にApple Accountへ請求されます。Daynaryは、購入可能にする前に、月額商品のStoreKit期間が1か月、年額商品のStoreKit期間が1年であることを確認します。解約しない限り、選択した期間ごとに自動更新されます。
解約はApple Accountのサブスクリプション管理から行うことができ、通常は現在の支払済み期間の終了時にPremiumが終了します。返金はAppleの規約と手続に従います。
4. 価格の変更
サブスクリプションの価格は将来変更される場合があります。変更後の価格は、Appleが必要な通知または同意確認を行ったうえで、その手続に従って将来の更新から適用されます。変更後の価格に同意しない場合は、適用前にサブスクリプションを解約できます。購入画面に表示されるStoreKitの価格を最新の価格として確認してください。
5. 解約・失効後のデータ
Premiumを解約または失効しても、既存のActivity、記録、取り込み済み記録、追加情報、カスタムカテゴリーおよび日テンプレートは削除・非表示にならず、保存先も変更されません。既存記録と追加情報は通常どおり閲覧・編集できます。新しい外部取り込みと、Premium専用の作成、編集、再利用、検索、分析および書き出しだけが利用できなくなります。
6. 禁止事項
法令または第三者の権利に違反する行為、アプリやAppleのサービスへ不正にアクセスする行為、動作を妨害する行為、リバースエンジニアリングその他標準EULAで禁止される行為をしてはなりません。
7. 提供内容の変更・中断
安全性、法令・プラットフォーム要件、OSやAppleサービスの変更、保守または障害への対応のため、機能を変更または一時中断する場合があります。ユーザーの権利や有料機能へ重大な影響がある変更は、合理的に可能な方法で事前に案内します。
8. 保証と責任
Daynaryは、適用法で認められる範囲で、常に中断やエラーがないこと、すべての端末間同期が一定時刻までに完了すること、または完全なバックアップとなることを保証しません。本条は、運営者の故意または重大な過失による責任や、消費者契約法その他の強行法規により制限できない責任を免除するものではありません。
9. 利用規約の変更
法令、サービス内容または運用の変更に応じて本利用規約を変更する場合があります。重要な変更は、合理的に可能な方法で適用前に案内し、更新日を変更します。
10. 準拠法
本利用規約には日本法を適用します。ただし、ユーザーの居住地で適用される消費者保護法その他の強行法規による権利を制限しません。紛争が生じた場合は誠実に協議し、解決しないときは適用法令に従う裁判所で解決します。

These Terms supplement Apple’s Standard End User License Agreement (Standard EULA) and apply to Daynary and its Premium subscription. By using Daynary, you agree to these Terms and the applicable Standard EULA.
1. The Service
Daynary is a tool for recording, reviewing, searching, analyzing, and exporting what you actually did each day. It does not provide medical care, diagnosis, treatment, or professional advice. The Free and Premium feature scopes are shown in the app’s Premium details.
2. Your Data and Storage
You retain rights to records that you enter or import. Records are stored persistently on the device and, when iCloud is available, sync between devices through private CloudKit. “iCloud Available” does not guarantee completed syncing or a complete backup. For important records, manage any copies you need using the app’s export features or other appropriate means.
3. Premium Subscription
Premium is available as a monthly or yearly auto-renewable subscription. The purchase screen shows each plan’s duration and actual price at the time of purchase. Daynary verifies that the monthly product has a one-month StoreKit period and the yearly product has a one-year StoreKit period before making either product available for purchase. Your Apple Account is charged when you confirm the purchase. The subscription renews for the selected period until canceled.
You can cancel from your Apple Account subscription settings, and Premium normally ends when the current paid period expires. Refunds follow Apple policies and procedures.
4. Price Changes
Subscription prices may change in the future. A changed price applies to future renewals through Apple’s process after Apple provides any required notice or consent request. If you do not agree to a changed price, you can cancel before it applies. Treat the StoreKit price displayed on the purchase screen as the current price.
5. Data After Cancellation or Expiration
Canceling Premium or allowing it to expire does not delete or hide existing activities, records, imported records, additional information, custom categories, or day templates, and it does not change their storage location. You can continue viewing and editing existing records and their additional information. Only new external imports and Premium-only creation, editing, reuse, search, analysis, and export actions become unavailable.
6. Prohibited Conduct
You must not violate laws or third-party rights, gain unauthorized access to the app or Apple services, interfere with operation, reverse engineer the app, or engage in conduct prohibited by the Standard EULA.
7. Changes and Interruptions
Features may change or be interrupted temporarily to address security, legal or platform requirements, OS or Apple-service changes, maintenance, or failures. Material changes affecting user rights or paid features will be communicated in advance when reasonably possible.
8. Warranties and Liability
To the extent permitted by applicable law, Daynary does not guarantee uninterrupted or error-free operation, completion of every device-to-device sync by a particular time, or a complete backup. This section does not exclude liability for intentional misconduct or gross negligence, or any liability that cannot be limited under consumer protection or other mandatory law.
9. Changes to These Terms
These Terms may change in response to changes in law, the service, or its operation. Material changes will be communicated before they apply when reasonably possible, and the last-updated date will be revised.
10. Governing Law
These Terms are governed by the laws of Japan, without limiting rights under mandatory consumer-protection or other laws that apply where you live. The parties will first attempt to resolve disputes in good faith, and unresolved disputes will be handled by a court with jurisdiction under applicable law.
